2. Interpretation and Definitions

Interpretation: Words with capitalized initial letters have meanings defined below, regardless of whether they appear in singular or plural.

3. Acknowledgment and Acceptance

By accessing the Website or completing a reservation, You acknowledge that You have read, understood, and agree to be bound by these Terms.

4. Security Deposit and Damage Authorization

The Company reserves the right to require a security deposit or pre-authorization hold prior to check-in. Guest authorizes the Company to charge the payment method on file for any damages to the Property, missing items, excessive cleaning, smoking violations, unauthorized pets, noise violations, fines imposed by governmental authorities or condominium associations, or any breach of these Terms. Any remaining balance of a refundable deposit, if applicable, will be returned within a reasonable time after checkout, less any deductions.

5. Force Majeure

The Company shall not be liable for cancellations, interruptions, or inability to provide accommodations due to events beyond its reasonable control, including but not limited to hurricanes, tropical storms, flooding, power outages, governmental actions, building closures, or other force majeure events. No refunds shall be issued except as expressly stated in the cancellation policy applicable at the time of booking.

6. Eligibility and Age Requirement

You must be at least 21 years of age to use the Service or complete a reservation.

7. Reservations and Payments

All reservations are subject to availability and confirmation. Payments are processed through approved third-party providers.

8. User Information

You agree to provide accurate, current, and complete information and confirm that you are authorized to use the provided payment method.

9. Cancellations and Modifications

Cancellation policies are disclosed during booking. Violations of house rules or laws may result in termination without refund.

10. House Rules, Noise, and Occupancy Policy

Guests must comply with all house rules, local ordinances, noise restrictions, and occupancy limits. Parties and events are strictly prohibited.

Guest agrees to comply with all applicable local laws and ordinances. Guest shall be solely responsible for any fines, penalties, or violations issued by the City, County, State, homeowners association, or condominium association resulting from Guest’s conduct or that of invitees. Guest authorizes the Company to charge such amounts to the payment method on file.

11. Check-In and Check-Out

Check-in and check-out times are specified in the booking confirmation. Unauthorized early check-in or late check-out may result in additional charges. Failure to vacate the Property at the scheduled check-out time may result in additional fees and/or removal in accordance with applicable law.

12. Smoking and Pets Policy

Smoking is strictly prohibited inside the Property unless explicitly authorized in writing. Evidence of smoking may result in additional cleaning and remediation fees. Pets are not permitted unless expressly approved in writing. Unauthorized pets may result in immediate termination without refund and additional charges.

13. Surveillance and Security Devices

Certain exterior areas of the Property may be monitored by security cameras for safety and compliance purposes. No surveillance devices are located inside private interior spaces. Tampering with security devices is strictly prohibited.

14. Availability, Errors, and Accuracy

We reserve the right to correct errors or cancel reservations if inaccuracies are discovered.

15. User Accounts

You are responsible for maintaining the confidentiality of your account credentials.

16. Intellectual Property

All content and materials on the Website are the exclusive property of Escape2 Miami.

17. Feedback

Feedback may be used by the Company without compensation or restriction.

18. Links to Third-Party Websites

We are not responsible for third-party content or practices.

19. Termination

We may suspend or terminate access for violations of these Terms.

20. Limitation of Liability

Liability is limited to the amount paid or USD $100, whichever is less.

21. AS IS Disclaimer

The Service is provided on an 'AS IS' and 'AS AVAILABLE' basis.

22. Governing Law

These Terms are governed by the laws of the State of Florida.

23. Dispute Resolution

Disputes must first be attempted to be resolved informally.

24.Severability and Waiver

If any provision is invalid, the remaining provisions remain in effect.

25. Changes to These Terms

We may modify these Terms at any time. Continued use constitutes acceptance.
